BE IT REMEMBERED that on February 9, 2010, came on to be heard the above numbered and entitled cause wherein Texas Land Finance Company II, assignee of Tarrant County and the taxing authorities which it represents, is the Plaintiff and Defendant HSBC Bank, USA, National Association, as Trustee for the Holders of the Deutsche ALT-A Securities Mortgage Loan Trust (hereinafter “Defendant”), although having been duly and legally cited to appear, failed to appear and answer and wholly made default.

The Plaintiff, having moved the Court to admit its proof of fact, which evidence was submitted concerning the ownership and title of the property described below and the tax records of Plaintiff were introduced in evidence, and evidence was submitted as to the value of the described property; and the Court, having heard the evidence, reviewed the pleadings and considered the argument of counsel, is of the opinion and finds as follows:

The above named Defendant was duly and lawfully served with citation, but failed to appear and answer and wholly made default. The citations were served according to law and return to the Clerk where they remained on file for the time required by law. Defendant is the owner of record of the below-described property. The Plaintiff is the lawful assignee of the ad valorem lien rights of the Tarrant County and the taxing authorities which it represents under Section 32.06 of the Tax Code. The property was located within the boundaries of Tarrant County, Texas, upon the dates when the taxes were assessed. There are taxes, penalties, interest, and costs due, owing, and unpaid to Plaintiff as the lawful assignee of Tarrant County and the taxing authorities in the amounts set out below upon the described surface estate. The taxes, penalties, interest, and costs constitute a separate, valid, and subsisting lien in favor of Plaintiff on the surface estate hereinafter described which lien is prior and superior to all claims, right, title, interest, or liens asserted by the Defendant.

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that there is due, owing, and unpaid to Plaintiff the following amounts for delinquent taxes, accrued penalties, interest, attorney’s fees and costs for year 2007 upon the following described property as set out below, together with additional interest as set forth in Plaintiff’s Promissory Note which accrues hereafter on all of said sums due from the date of judgment until paid.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that a lien exists against all of the above-described surface estate, for the total amount due hereunder, which lien is prior and superior to all claims, right, title, interest, or liens asserted by any Defendant, and Plaintiff have foreclosure of its liens on the above-described against the Defendant or any person claiming under the Defendant by any right acquired during the pendency of this suit; and that this Order of Sale be issued by the Clerk directed to the Sheriff, any Constable of this County, or agent designated by the Plaintiff, commanding same to seize, levy upon, and advertise the sale of the said surface estate, and sell it to the highest bidder for cash, as under execution, such order to have all the force and effect of a writ of possession as between the parties to this suit and any person claiming under the Defendant by any right acquired pending this suit, and such Order of Sale to further provide that the property may be sold to a taxing unit or its assignee that is a party to this suit or to any other person, other than a person owning an interest in the property or any party to this suit that is not a taxing unit, for the adjudged value of the property or the aggregate amount of the judgments against the property, whichever is less. The Order of Sale shall also specify that the property may not be sold to a person owning an interest in the property or to a person who is a party to the suit other than a taxing unit unless: (1) that person is the highest bidder at the tax sale, and (2) the amount bid by that person is equal to or greater than the aggregate amount of the judgments against the property, including all costs of suit and sale. The adjudged value, or reasonable fair value, of the property as set by this Court is as shown above, and, if no amount is shown, the Court did not fix such adjudged value, but if the Defendant shall, at any time before the sale, file a written request with the officer in whose hands the order of sale is placed, that the property described therein be divided and sold, then the officer shall sell the property in such subdivisions as the Defendant may request and, in such case, shall only sell as many subdivisions as necessary to satisfy this judgment, interest and costs; the net proceeds of any sale of such property made hereunder to any purchaser other than a taxing unit who is a party to this suit shall be applied to satisfy the judgment and liens foreclosed herein, but any excess in the proceeds of sale over the amount of judgment, the costs of suit and sale and other expenses chargeable against the property, shall be paid into the registry of the court and disbursed therefrom as provided by law; that the owner of such property, or anyone having an interest therein, or their heirs, assigns, or legal representatives, may redeem such property in the time and manner prescribed by law; that the officer executing the Order of Sale shall make proper conveyance to the purchaser(s) of the land, as prescribed by law, subject to such right of redemption, and shall proceed to place the purchaser(s) of said land in possession thereof within thirty (30) days after the day of sale; and that the clerk of this Court issue a Writ of Possession to the purchaser at the sale or to the purchaser’s assigns no sooner than twenty (20) days following the date on which the purchaser’s deed from the officer making the sale is filed of record.

WHEREAS, on October 20, 2003, a certain Mortgage Security Instrument was executed by Curtis A. Wright and wife, Johnnie N. Wright as mortgagors in favor of Bank of Salem, as mortgagee and Tommy Bastian as trustee, and was recorded on November 5, 2003, as Instrument No. D203413754 in the office of the County Clerk, Tarrant County, Texas;

Public comment will be received regarding a proposed amendment to the Program Year 2008 Consolidated Action Plan.  The amendment will entail reallocation of funds between activities within the Neighborhood Stabilization Program (NSP).  Specifically, $189,500 remaining from the financing mechanisms activity initially set for financing for purchase and redevelopment costs will be reallocated to Acquisition/Rehabilitation and Resale activity. Under the Acquisition/Rehabilitation and Resale activity, the number of units acquired, rehabilitated and sold will change from 16 units to 12 units and the budget per house assisted will change from $120,000 to $150,000 and a developer fee available upon resale of 15 percent.

A public hearing will be held at 10:00 a.m. on Tuesday, March 16, 2010 in the Tarrant County Administration Building, Fifth Floor, Commissioners Courtroom, 100 East Weatherford, Fort Worth, TX 76196.

NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on March 31, 2006, a certain Adjustable Rate Home Equity Conversion Deed of Trust was executed by Mildred B. Stromberg, as mortgagor, in favor of Financial Freedom Senior Funding Corporation, a subsidiary of IndyMac Bank, F.S.B., as mortgagee and Brown, Fowler & Alsup, as trustee and was recorded on April 10, 2006 under Clerk’s Document Number D206103511 in the real property records of Tarrant County, Texas.       

WHEREAS, the Adjustable Rate Home Equity Conversion Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the “Secretary”) pursuant to the National Housing Act for the purpose of providing single family housing; and

WHEREAS, the beneficial interest in the Adjustable Rate Home Equity Conversion Deed of Trust is now owned by the Secretary by virtue of an Corporation Assignment of Deed of Trust executed by Financial Freedom Senior Funding Corporation on February 10, 2009 and filed in Tarrant County on February 25, 2009 under Clerk’s Document Number D209051177 of the real property records of Tarrant County; and   

WHEREAS, a default has been made in the covenants and conditions of the Adjustable Rate Home Equity Conversion Deed of Trust in that the Mortgagor is deceased.

When making their bids, all bidders except the Secretary must submit a deposit totaling $13,536.50 in the form of a certified check or cashier’s check made out to the Secretary of HUD.   Each oral bid need not be accompanied by a deposit.  If the successful bid is oral, a deposit of $13,536.50 must be presented before the bidding is closed.  The deposit is nonrefundable.  The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence.  This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check.  If the Secretary is the high bidder, he need not pay the bid amount in cash.  The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment and all other costs associated with the transfer of title.  At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act.  Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein.  HUD does not guarantee that the property will be vacant.

NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on March 31, 2006, a certain Adjustable Rate Home Equity Conversion Deed of Trust was executed by Mildred B. Stromberg, as mortgagor, in favor of Financial Freedom Senior Funding Corporation, a subsidiary of IndyMac Bank, F.S.B., as mortgagee and Brown, Fowler & Alsup, as trustee and was recorded on April 10, 2006 under Clerk’s Document Number D206103511 in the real property records of Tarrant County, Texas.       

WHEREAS, the Adjustable Rate Home Equity Conversion Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the “Secretary”) pursuant to the National Housing Act for the purpose of providing single family housing; and

WHEREAS, the beneficial interest in the Adjustable Rate Home Equity Conversion Deed of Trust is now owned by the Secretary by virtue of an Corporation Assignment of Deed of Trust executed by Financial Freedom Senior Funding Corporation on February 10, 2009 and filed in Tarrant County on February 25, 2009 under Clerk’s Document Number D209051177 of the real property records of Tarrant County; and   

WHEREAS, a default has been made in the covenants and conditions of the Adjustable Rate Home Equity Conversion Deed of Trust in that the Mortgagor is deceased.

When making their bids, all bidders except the Secretary must submit a deposit totaling $13,536.50 in the form of a certified check or cashier’s check made out to the Secretary of HUD.   Each oral bid need not be accompanied by a deposit.  If the successful bid is oral, a deposit of $13,536.50 must be presented before the bidding is closed.  The deposit is nonrefundable.  The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence.  This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check.  If the Secretary is the high bidder, he need not pay the bid amount in cash.  The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment and all other costs associated with the transfer of title.  At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.  

The Secretary may grant an extension of time within which to deliver the remainder of the payment.  All extensions will be for 15-day increments for a fee of $1,000, paid in advance.  The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD.  If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.

The Commissioner may, at the direction of the HUD Field Office Representative, offer the Property to the second highest bidder for an amount equal to the highest price offered by that bidder.  

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act.  Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein.  HUD does not guarantee that the property will be vacant.  

The amount that must be paid if the Mortgage is to be paid in full prior to the scheduled sale is $135,365.01 as of March 2, 2010, plus all other amounts that would be under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searchers, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred-in connection with the foreclosure prior to reinstatement.

NOTICE IS HEREBY GIVEN to the public and to all interested persons that under the legal authority and jurisdiction of Title 3, Oil and Gas, Subtitles A, B, and C of the Texas Natural Resources Code, Chapters 26, 27 and 29 of the Texas Water Code, and TEX. Applicant seeks an exception to the lease line distance requirement of the field rules for the Newark, East (Barnett Shale) Field, because the applicant is less than the required Rule 37 lease line distance to multiple tracts internal to the pooled unit having unleased or non-pooled interest, being 31 feet to the nearest lease line. A copy of the plat filed by the applicant with its drilling permit application is attached to this notice for reference purposes.

Applicant has made application for an amended new drill permit for Well No. 1H, Mount Tabor Lease, Ashabranner, G. J. Survey, A-7, Newark, East (Barnett Shale) Field, Tarrant County, Texas, being 0 miles within Fort Worth, Texas.

NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on March 31, 2006, a certain Adjustable Rate Home Equity Conversion Deed of Trust was executed by Mildred B. Stromberg, as mortgagor, in favor of Financial Freedom Senior Funding Corporation, a subsidiary of IndyMac Bank, F.S.B., as mortgagee and Brown, Fowler & Alsup, as trustee and was recorded on April 10, 2006 under Clerk’s Document Number D206103511 in the real property records of Tarrant County, Texas.       

WHEREAS, the Adjustable Rate Home Equity Conversion Deed of Trust was insured by the United States Secretary of Housing and Urban Development (the “Secretary”) pursuant to the National Housing Act for the purpose of providing single family housing; and

WHEREAS, the beneficial interest in the Adjustable Rate Home Equity Conversion Deed of Trust is now owned by the Secretary by virtue of an Corporation Assignment of Deed of Trust executed by Financial Freedom Senior Funding Corporation on February 10, 2009 and filed in Tarrant County on February 25, 2009 under Clerk’s Document Number D209051177 of the real property records of Tarrant County; and   

WHEREAS, a default has been made in the covenants and conditions of the Adjustable Rate Home Equity Conversion Deed of Trust in that the Mortgagor is deceased.

When making their bids, all bidders except the Secretary must submit a deposit totaling $13,536.50 in the form of a certified check or cashier’s check made out to the Secretary of HUD.   Each oral bid need not be accompanied by a deposit.  If the successful bid is oral, a deposit of $13,536.50 must be presented before the bidding is closed.  The deposit is nonrefundable.  The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence.  This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check.  If the Secretary is the high bidder, he need not pay the bid amount in cash.  The successful bidder will pay all conveying fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment and all other costs associated with the transfer of title.  At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned to them.  

The Secretary may grant an extension of time within which to deliver the remainder of the payment.  All extensions will be for 15-day increments for a fee of $1,000, paid in advance.  The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD.  If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.

The Commissioner may, at the direction of the HUD Field Office Representative, offer the Property to the second highest bidder for an amount equal to the highest price offered by that bidder.  

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor or others subsequent to a foreclosure completed pursuant to the Act.  Therefore, the Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein.  HUD does not guarantee that the property will be vacant.  

The amount that must be paid if the Mortgage is to be paid in full prior to the scheduled sale is $135,365.01 as of March 2, 2010, plus all other amounts that would be under the mortgage agreement if payments under the mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and for the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searchers, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred-in connection with the foreclosure prior to reinstatement.
