OF ADOPTION OF AMENDMENT TO GENERAL ORDINANCE
BY
TARRANT REGIONAL WATER DISTRICT
(HEREAFTER
REFERRED TO AS THE DISTRICT)
This
Notice is published to advise all persons who may desire to go near or upon the
approximately 400 acres of parkland known as Eagle Mountain Park (the “Park”)
owned by the District and located in Tarrant County, Texas bordering the east
side of Eagle Mountain Lake south of Peden Road and west of Morris Dido Newark
Road, that on the 15th day of April, 2008, the District amended its General
Ordinance governing the use of the Park.
This
Notice will not set out in full the entire content of such amendment to the
General Ordinance enacted by the Board of Directors of Tarrant Regional Water
District on the 15th day of April, 2008, but will give a substantive statement
as condensed as is possible to intelligently explain the purposes to be
accomplished or the acts forbidden by this amendment to the General Ordinance.
Where not otherwise provided, upon conviction of the violation of any of the
provisions of the amendment to the General Ordinance enacted by the District,
the person found guilty may be punished by a fine of not more than $500.00, and
a civil penalty of not more than $1,000.00 for each violation or each day of a
continuing violation.
This
Notice will be published twice, once a week for two consecutive weeks, and the
penalty provisions of the amendment to the General Ordinance will be in full
force and effect not earlier than the sixth day next after the second such
publication.
SYNOPSIS
OF THE AMENDMENT TO THE GENERAL ORDINANCE
1.
Declaring the general policies of the District to preserve the Park as
undeveloped, public access parkland.
2.
Declaring regulations to preserve the ecology and natural habitat of the Park.
3.
Declaring regulations to permit only low-impact recreational and educational
uses of the Park.
4.
Declaring regulations relative to protecting the health and safety of all
persons entering the Park.
5.
Declaring certain exemptions for the District, law enforcement agencies, and
emergency personnel.
6.
Declaring penal fines and civil penalties for the violations of the regulations
applicable to the Park.
7.
Declaring rules for the construction of the regulations applicable to the Park.
Notice
is hereby given that all persons desiring to go near or upon the Park, for any
purpose whatsoever, should fully acquaint themselves with the entire content of
the amendment to the General Ordinance, of which due and legal Notice is here
being given. Such persons are hereby advised that the sixth day next after the
second publication of this Notice, the District’s amendment to the General
Ordinance shall be recognized by courts as if same were a penal ordinance of a
city. Ignorance of the terms of the amendment to the General Ordinance is not a
defense to prosecution for the enforcement of the penalties therein provided.
In

convenient as possible, the full text of the amendment to the General Ordinance
is available to be read by any interested person at the following locations:

on January 22, 2008, the Board of Education Ordered an election on May 10,
2008, for the purpose of electing a member to represent Single Member
Districts: District One, (4 year term or until a successor has been duly
elected and qualified), District Four, (4 year term or until a successor has

BE IT
ORDERED by the Board of Education of the Fort Worth Independent School District
that on May 10, 2008, there shall be a general election for the purpose of
electing five (5) members to the Board of Education. One member shall be
elected from Single Member District One to serve a four (4) year term, or until
a successor has been duly elected and qualified. One member shall be elected
from Single Member District Four to serve a four (4) year term, or until a successor

FURTHER ORDERED that all candidates seeking election as a board member must reside
within the single member district for the single member district position they
seek and all candidates seeking election as president of the Board of Education
must reside within the boundaries of the Fort Worth Independent School
District. Pursuant to state law, each candidate must reside in the specific
single member district or in the case of the Board President in the school
district for six (6) months preceding the final day to file for such office,
the final day to file is March 10, 2008; and
BE IT
FURTHER ORDERED that every candidate must designate that he or she is a
candidate for a specific single member district or Board President, on his or
her application to become a candidate. Such application shall be filed with the
Secretary of the Board, or his designee, not later than 5:00 p.m. on the 10th
day of March, 2008; and
BE IT
FURTHER ORDERED that on the second Saturday in May 2008, being the 10th day of
May, 2008, the election shall be held from 7:00 a.m. to 7:00 p.m. on said day. If
no candidate receives a majority of the votes cast for the office for which he
or she is a candidate, a runoff election shall be held on the 14th day of June,
2008. Only the names of the two candidates who received the highest number of
votes for the office for which a runoff is required shall be placed on the
ballot for such runoff election; and

FURTHER ORDERED that notice of said election shall be given by publishing the
Election Order in a newspaper in the City of Fort Worth, and by posting Notice
of this ORDER OF ELECTION prior to April 18, 2008 on the bulletin board used
for posting notices of meetings of the Fort Worth Independent School District.
Notice may be published, prior to February 9, 2008, so as to give notice of the
opportunity to submit applications to be placed on the ballot as a candidate.
Notice shall be published between the dates of April 10, 2008 and April 30,
2008 in accordance with Section 4.003, Texas Election Code; and

FURTHER ORDERED that Steve Raborn is hereby appointed Early Voting Clerk. His
mailing address is 2700 Premier Street, Fort Worth, Texas 76116-0011. Gayle
Williams is hereby appointed Deputy Clerk for Early Voting. Early voting for
the election of school board members shall be held at the times and locations
identified and listed herein, which is made a part of this Election Order. The
Board finds, determines, and declares that those designated early polling

ORDENA QUE el segundo sábado de mayo del 2008, o sea el 10 de mayo del 2008,
las elecciones se lleven a cabo de 7:00 a.m. a 7:00 p.m. dicho día. Si ningún
candidato recibe la mayoría de votos para el puesto al que postula, se llevará
a cabo una elección de desempate el día 14 de junio del 2008. Solamente se
pondrán en las balotas de dicha elección los nombres de los dos candidatos que
recibieron la mayoría de votos en las elecciones para dicho puesto y

FOR RELEASE OF FUNDS
On or
about May 16, 2008 Tarrant County will submit a request to the US Department of
Housing and Urban Development (HUD) to release federal funds under the Housing
and Community Development Act, as amended, and under Title II of the
Cranston-Gonzalez National Affordable Housing Act, as amended, and under the
Stewart B. McKinney Homeless Assistance Act, as amended, for the following
projects during PY 2008.

DEVELOPMENT BLOCK GRANT (CDBG) PUBLIC WORKS PROJECTS

$895,736 Water and Sewer Line Improvements in Azle (Alameda Rd.), Crowley (n.
Texas St.), Eukess (W. Mills Dr.), Everman (Edna Dr.), Grapevine (E. Worth
St.), Kennedale (New Hope Rd.), Lake Worth (Dakota Trail), River Oaks
(Montrose), Sansom Park (Arrow-Graham), Westworth Village (Alley south of

$684,033.25 Occupied Housing Rehabilitation throughout Tarrant County for
approximately 30 low income households experiencing a major system failure.
Environmental assessments to be performed on a project-by-project basis as
sites for rehabilitation are selected in accordance with Tarrant County’s
Unspecified Site Strategy per 24 CFR 58.15 and 24 CFR 58.32.

$176,806.65 Community Housing Development Organization (CHDO). Tarrant County
will contract with eligible CHDO’s to create affordable housing including
acquisition, new construction, rehabilitation and homebuyer assistance for
approximately five units.
These
projects are located in unspecified sites within the Tarrant County Urban
Consortium including unincorporated Tarrant County and the cities of Azle,
Bedford, Benbrook, Blue Mound, Burleson, Crowley, Dalworthington Gardens,
Euless, Everman, Forest Hill, Grapevine, Haltom City, Haslet, Hurst, Keller,
Kennedale, Lakeside, Lake Worth, Mansfield, North Richland Hills, Pantego,
Richland Hills, River Oaks, Saginaw, Sansom Park, Southlake, Watauga, Westworth
Village, and White Settlement. These proposed activities listed above are
determined to be categorically excluded during the broad review under HUD
regulations per 24 CFR 58.35(a)3(i). The site specific environmental review
will be conducted as sites for home
rehabilitation are identified and as sites for CHDO activities are identified
in accordance with Tarrant County’s Tiered Environmental Review Policy and
Procedures per 24 CFR 58.15 and 24 CFR 58.32.
FINDING
OF NO SIGNIFICANT IMPACT
Tarrant
County has determined that the projects will have no significant impact on the
human environment. Therefore, an
Environmental Impact Statement under the National Environmental Policy Act of
1969 (NEPA) is not required. Additional
project information is contained in the Environmental Review Record (ERR) on
file at the Tarrant County Community Development office at 1509-B South
University Drive, Suite 276, Fort Worth, Texas 76107 and may be examined or
copied weekdays from 8:00 A.M. to 4:30 P.M.
PUBLIC
COMMENTS
Any
individual, group, or agency disagreeing with this determination or wishing to
comment on the project may submit written comments to Tarrant County Community
Development at 1509-B South University Drive, Suite 276, Fort Worth, Texas
76107. All comments received by May 15,
2008 will be considered by Tarrant County prior to authorizing submission of a
request for release of funds.

RELEASE
OF FUNDS
Tarrant
County certifies to HUD that Judge B. Glen Whitley in his official capacity as
Tarrant County Judge consents to accept the jurisdiction of the Federal Courts
if an action is brought to enforce responsibilities in relation to the
environmental review process and that these responsibilities have been
satisfied. HUD’s approval of the
certification satisfies its responsibilities under NEPA and related laws and
authorities, and allows the Tarrant County to use Program funds.
OBJECTIONS
TO RELEASE OF FUNDS
HUD
will consider objections to its release of funds and Tarrant County’s
certification received by June 2, 2008 or a period of fifteen days from its
receipt of the request (whichever is later) only if they are on one of the
following bases: (a) the certification was not executed by the Certifying
Officer or other officer of Tarrant County approved by HUD; (b) Tarrant County has omitted a step or
failed to make a decision or finding required by HUD regulations at 24 CFR Part
58; (c) the grant recipient or other participants in the project have committed
funds or incurred costs not authorized by 24 CFR Part 58 before approval of a
release of funds by HUD; or (d) another Federal agency acting pursuant to 40
CFR Part 1504 has submitted a written finding that the project is
unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in
accordance with the required procedures (24 CFR Part 58) and shall be addressed
to Department of Housing and Urban Development Attn: Environment Division at
801 Cherry Street, 28th Floor, Fort Worth, Texas, 76113-2905. Potential
objectors should contact HUD to verify the actual last day of the objection
period.
