NOTICE IS HEREBY GIVEN to
the public and to all interested persons that under the legal authority and jurisdiction
of Title 3, Oil and Gas, Subtitles A, B, and C of the Texas Natural Resources
Code, Chapters 26, 27 and 29 of the Texas Water Code, and TEX. GOV’T CODE ANN.
art. 2001 et seq. (2010), the RAILROAD COMMISSION OF TEXAS will hold a
hearing on FEBRUARY 18, 2010, at 10:00 a.m. at the William B. Travis State
Office Building, 1701 N. Congress Avenue, Austin, Texas. This hearing will be
conducted in conformity with the TEX. GOV’T CODE ANN. art. 2001 et seq.

The Commission will
consider the application of Chesapeake Operating Inc. for a spacing exception
permit under the provisions of 16 Texas Administrative Code 3.37 (Railroad

exception to the lease line distance requirement of the field rules for the
Newark, East (Barnett Shale) Field, because the applicant is less than the
required Rule 37 lease line distance to multiple tracts internal to the pooled
unit having unleased or non-pooled interest, being 31 feet to the nearest lease

WHEREAS, on May 15, 2003,
a certain Mortgage Security Instrument was executed by James W. White, and
Juanita M. White, et ux as mortgagors in favor of Wells Fargo Home Mortgage,
Inc., as mortgagee and Robert K. Fowler as trustee, and was recorded on June 5,
2003, as Instrument No. D203200757 in the office of the County Clerk, Tarrant
County, Texas; and
WHEREAS, the Mortgage
Security Instrument was insured by the United States Secretary of Housing
and Urban Development (the Secretary) pursuant to the National Housing Act for
the purpose of providing single family housing; and
WHEREAS, the Mortgage
Security Instrument is now owned by the Secretary, pursuant to an assignment

If the high bidder is
unable to close the sale within the required period, or within any extensions
of time granted by the Secretary, the high bidder may, at the election of the
foreclosure commissioner after consultation with the HUD Field Office
Representative, be liable to HUD for any costs incurred as a result of such
failure. The Commissioner may, at the direction of the HUD Field Office
Representative, offer the Property to the second highest bidder for an amount
equal to the highest price offered by that bidder.
There is no right of
redemption, or right of possession based upon a right of redemption, in the

the public and to all interested persons that under the legal authority and
jurisdiction of Title 3, Oil and Gas, Subtitles A, B, and C of the Texas

FORECLOSURE SALE
WHEREAS, on May 15, 2003,
a certain Mortgage Security Instrument was executed by James W. White, and
Juanita M. White, et ux as mortgagors in favor of Wells Fargo Home Mortgage,
Inc., as mortgagee and Robert K. Fowler as trustee, and was recorded on June 5,
2003, as Instrument No. D203200757 in the office of the County Clerk, Tarrant
County, Texas; and
WHEREAS, the Mortgage
Security Instrument was insured by the United States Secretary of Housing
and Urban Development (the Secretary) pursuant to the National Housing Act for
the purpose of providing single family housing; and
WHEREAS, the Mortgage
Security Instrument is now owned by the Secretary, pursuant to an assignment
dated June 22, 2007, and recorded on November 14, 2007, as Instrument No.
D207407350, in the Office of the County Clerk, Tarrant County, Texas; and
WHEREAS, a default has
been made in the covenants and conditions of the Mortgage Security Instrument
in the mortgagor is deceased, which accelerated the maturity of the mortgage debt
and subjected the Property to payment of all principal, interest, and other
fees allowed under the Loan Agreement;
WHEREAS, the entire amount
delinquent as of February 2, 2010 is approximately $ 103,251.46, with a per
diem of $ 6.82; and
WHEREAS, by virtue of this
default, the Secretary has declared the entire amount of the indebtedness
secured by the Mortgage Security Instrument to be immediately due and payable;

When making their bids,
all bidders except the Secretary must submit payment totaling the total amount
due under the terms of the Loan Agreement as of the date of sale, or if any bid
exceeds this amount, the greater of the total amount due under the terms of the
Loan Agreement as of the date of sale or the highest bid in the form of a
certified check or cashier’s check made out to the Secretary of HUD. This amount
must be delivered in the form of a certified or cashier’s check. If the
Secretary is the high bidder, he need not pay the bid amount in cash. The successful
bidder will pay all conveyancing fees, all real estate and other taxes that are
due on or after the delivery of the remainder of the payment and all other
costs associated with the transfer of title.
If the high bidder is
unable to close the sale within the required period, or within any extensions
of time granted by the Secretary, the high bidder may, at the election of the
foreclosure commissioner after consultation with the HUD Field Office
Representative, be liable to HUD for any costs incurred as a result of such
failure. The Commissioner may, at the direction of the HUD Field Office Representative,
offer the Property to the second highest bidder for an amount equal to the
highest price offered by that bidder.
There is no right of
redemption, or right of possession based upon a right of redemption, in the
mortgagor or others subsequent to a foreclosure completed pursuant to the Act. Therefore, the
Foreclosure Commissioner will issue a Deed to the purchaser(s) upon receipt of
the entire purchase price in accordance with the terms of the sale is provided
herein. HUD does not guarantee that the property will be vacant.

the public and to all interested persons that under the legal authority and
jurisdiction of Title 3, Oil and Gas, Subtitles A, B, and C of the Texas

WHEREAS, on May 15, 2003,
a certain Mortgage Security Instrument was executed by James W. White, and
Juanita M. White, et ux as mortgagors in favor of Wells Fargo Home Mortgage,
Inc., as mortgagee and Robert K. Fowler as trustee, and was recorded on June 5,
2003, as Instrument No. D203200757 in the office of the County Clerk, Tarrant
County, Texas; and
WHEREAS, the Mortgage
Security Instrument was insured by the United States Secretary of Housing
and Urban Development (the Secretary) pursuant to the National Housing Act for
the purpose of providing single family housing; and
WHEREAS, the Mortgage
Security Instrument is now owned by the Secretary, pursuant to an assignment

NORTHERN TRINITY GROUNDWATER CONSERVATION DISTRICT NOTICE OF HEARING

NOTICE IS HEREBY GIVEN to all interested persons within Tarrant County, Texas:
That the Board of Directors of the Northern Trinity Groundwater Conservation District (“District”) will hold a public rulemaking hearing, accept public comment, and may take action on the adoption of proposed temporary District Rules regulating water wells within the boundaries of the District, which includes all of Tarrant County, Texas. The proposed rules may: require the registration of certain water wells within the boundaries of the District; establish well drilling, completion, and location requirements; require certain persons to obtain and install meters for their wells, maintain the meters, and record monthly and annual groundwater production amounts and report such amounts to the District; establish certain fees, including a water use fee of three cents per 1,000 gallons of groundwater produced, for persons producing water from certain water wells located within the District; establish a groundwater export surcharge over and above the amount of the water use fee for producing groundwater in the District and transporting such water for use outside of the District; establish an incentive program for early fee payment; establish penalties for violations of the rules, including monetary civil penalties; establish certain exemptions for the well registration, reporting, fee payment, and metering requirements; prohibit the waste of groundwater; and establish other rules and regulations regarding water wells in the District.
This rulemaking hearing will be held on Thursday, January 14, 2010, beginning at 6:00 p.m. in the 5th Floor, Commissioners Courtroom, Tarrant County Administration Building, 100 East Weatherford Street, Fort Worth, Texas, 76196.
Any person who desires to appear at the hearing and present comment or other information on the proposed District Rules may do so in person, by counsel, or both. Comments may be presented verbally or in written form. Limits may be placed on the amount of time that each person is allowed to present verbal comments. The hearing posted in this notice may be recessed from day to day or continued where appropriate.
