Constable of Sheriff's Sales:
Sale of real property (home/land) by one of the taxing authorities of Tarrant County for collection of unpaid taxes or for an abstract of judgment.

An "abstract of judgment" is a court ordered judgment against the property owner giving right to the lender of a debt to foreclose on a property (not a homestead) to collect on the debt. A written summary of a judgment which states how much money the losing party owes to the person who won the lawsuit (judgment creditor), the rate of interest to be paid on the judgment amount, court costs, and any specific orders that the losing party (judgment debtor) must obey, which abstract is acknowledged and stamped so that it can be recorded at the county recorder. The purpose of an abstract of judgment is to create a public record and create a lien or claim if necessary on any real estate owned or later acquired by the loser located in the county which the abstract of judgment is recorded. If the loser does not pay the judgment voluntarily then the winner can force a constable's sale of any property to collect.
By statute, all real property has to be sold at a public auction on the first Tuesday of the month at the Tarrant County Courthouse. Properties to be auctioned are published 21 days prior to the auction in the Commercial Recorder. The list is published the last three Tuesdays of every month; e.g., properties published the last three Tuesdays in May will be auctioned on the first Tuesday in June. There are two (2) types of foreclosure sales, trustee and Constables (Sheriff's) sales, that by law must be auctioned for sale at a public auction. By statute in Texas, all foreclosed real property must be sold at a public auction on the first Tuesday of the month at the County courthouse or at a designated place chosen by the county commissioners court. In Tarrant County that designated location is the east side of the Tarrant County courthouse (with a clock in the tower) in downtown Fort Worth. Properties to be auctioned are published twenty-one (21) days prior to the auction in the Commercial Recorder. More specifically, the list of foreclosed properties si published the last three (3) Tuesday editions of every month; e.g., properties published the last three (3) Tuesdays in May will be auctioned on the first Tuesday in June.
